The application of birthright citizenship to children of illegal immigrants remains controversial.[6] The Pew Hispanic Center estimates that approximately 7.5% of all births in the U.S. (about ,000 births per year) are to unauthorized immigrants.[7] The Pew Hispanic Center also estimates that there are 4.5 million children who were born to unauthorized immigrants that received citizenship by birth in the United States, while the Migration Policy Institute estimates that there are 4.1 million children. Both estimates exclude anyone 18 and older who might have benefited.[7][8] On January 24, 2020, the Trump administration adopted a policy to make it more difficult for pregnant foreign women to come to the US where it is suspected that the purpose is to give birth on US soil and thereby to ensure their children become US citizens, a practice commonly known as "birth tourism."[9]

The legality of citizenship of just being born on our soil is a bad court decision that ignored one simple clause: "...and subject to the jurisdiction thereof..." Simple, position on our soil should not be qualifying enough in and of itself. Being here illegally, is not subjection to the jurisdiction by the parents and should disqualify the right of citizenship to their progeny -- until they or the child goes through the legal process of immigration and onto the path of citizenship determined by law. The children of legal residents could possibly qualify, because they are subject to the jurisdiction.
