No to resolution 1. There is no need to override the constitution. A governor should be afforded the powers to respond to an emergency. And, the legislature should take a back seat to emergencies pending a 2/3s majority overrule.
Yes to resolution 2. If a governor can't convince the people's legislature to back an "emergency" after 4 weeks of time (I'd actually propose 30 days, but oh well) then it isn't an emergency.
Further, resolution 2 is not a change to the constitution but just a change to Title 35 Section 7301, a law. So I agree that the language is not just misleading but wrong. But, we've come to expect a failed attempt at a low bar from our former Secretary Brookvar.
Also, when the legislature is deciding whether to back an emergency measure, they should be tasked with covering the states "takings" due to responding to the emergency. If the common good is to be promoted by an emergency measure then it is the responsibility of the commons to make whole all those the state has taken from during the emergency.
I'd also put language in there to prevent a governor from abusing consecutive emergency powers. Something like "if the legislature fails to back an emergency declaration, a vote must be held by the legislature prior to reinstating the governor's emergency powers."
