The Civil War is not the relevant precedent. The relevant precedent is the Revolutionary War. This is basic law. Failure to offer remedy places those refusing to offer remedy outside the law by their choice to step outside the law. A declaration of independence is common law, going back to Ancient Times, it is based upon Commercial and Military Lien Rights, it is backed up with Bonding Code, and moral reason. Those choosing to close the gate to lawful remedy confess their criminality.
