It's more than a safety issue. Without a court date they can disappear in this great cauldron and never have a need to begin the process of actual legal immigration. Sounds great until you realize it will hurt them and US citizens in the long run. The life of a ghost sounds great but in fact it is always looking over your shoulders with no way to stop that existence.

@Poncho69 More than a scam. It hurts these people and their hoped for new life by preventing them from even starting any form of legal entry towards citizenship. If picked up for anything later they can and will be shipped back to their prior homes with no recourse to protect themselves.
