LINK Anarcho-Tyranny In Black And White

It’s now common for American juries and district attorneys to absolve blacks of responsibility for murders. Here are examples I highlighted in a Revolver article last year:

The three black men involved in Ethan Liming’s 2022 beating death saw their murder charges reduced to lesser offenses. One of the participants was only sentenced to 180 days in jail.

A black man in Iowa was found not guilty of murder last year for his role in the death of his white girlfriend. He severely beat the victim and the woman fell from her apartment balcony during the assault. She died from the fall. The jury found the black man not responsible for the death–only for the assault.

Kansas City officials refused to press murder charges against a black woman who shot and killed an off-duty white firefighter. The firefighter had confronted the woman’s boyfriend after he threatened a gas station clerk. The boyfriend fought the white man, but the fight was not going well for him. The girlfriend shot the firefighter, which authorities determined was in self-defense.

A black man in South Carolina was found not guilty in 2021 after shooting and killing a white retired volunteer fire chief as the victim sat in his car. The shooter claimed the victim startled him and that was a sufficient explanation to find him innocent of murder.

A black man in Florida was sentenced to house arrest in 2022 over the fatal beating of a white man who called him a slur. Prosecutors felt the punch that killed the 77-year-old victim merited a lenient sentence because “the victim repeatedly used possibly the most aggressive and offensive term in the English language.”

Prosecutors in Florida dropped charges in 2017 against a black man who beat his white math tutor to death after the victim allegedly used a racial slur. The prosecutor’s office felt it had no “competent evidence” to rebut the defendant’s claim he was provoked into violence and said the slaying was not done in a “cruel and unusual manner.”

The basis of our justice system is you punish the crime not the person. In other words that mitigating circumstances be spelled out in the law and not a matter of discretion by the judge or jury and certainly not at the discretion of the prosecutors and police. That is what blind justice means. The reasoning behind blind justice is that there are always mitigating circumstances. Poverty for example has never been an excuse for theft. Punishing the individual and not the crime is simply vengeance applied by the state. The point of the justice system being to maintain social order not satisfy our desire for fairness. In nature fairness may be an eye for an eye but in the civilized state fairness is tied to the individuals contribution to society or at least the level of disruption they cause.

If in fact racism is disruptive to the social order then acts of racial prejudice should be written into the law as mitigating circumstances. Which of course they are as hate crimes, and anti-discrimination laws. The problem arises out of the necessarily subjective nature of what is a hate crime or discrimination. What people seem unable to accept is that all laws are arbitrary red lines. They are never "fair". If the infinite number of circumstances were taken into account the laws would have to be infinite in definition. That is especially true when there are laws that involve subjective terms such as hate and discrimination. How do you set a red line for hate or discrimination? That is why there are criminal courts and civil courts. Criminal courts have strict rules for following the "letter of the law" while civil courts allow for more discretion. In civil courts fairness has a different meaning such as actual and punitive damages. Punitive damages being entirely subjective. It was a fairly good system. Hate and discrimination should probably never have been written into the criminal code due to the subjectivity involved. Only minor discretion in sentencing seems appropriate.

The justice system has become too convoluted. When that happens it gives prosecutors and the police too much discretion. Justice cannot come from the enforcement side. When that happens justice becomes arbitrary and socially disruptive. The enforcement side of the justice system has become the judge and jury.

In the above cases you can see that hate, even if justified, cannot be a consideration leading to selective enforcement. We have returned to wild justice where vengeance not social order are the driving force. If that were not the case then the charges would have simply been reduced under existing rules from murder to involuntary man slaughter which the law allows for as temporary insanity. No doubt hate can make a person insane but justice is mostly blind to those factors as a practical necessity.
