US law prohibits a citizen from having more than one active passport.
Doing the math three passports minus one expired equals two active passports.
You can read more about the law here and note that Trump doesn't have dual citizenship, so it's not one, isn't active military or a diplomat, so it's not two, and already said that only one was expired

USC Title 22 Sec 51.2b [1] provides the waiver criteria: "Unless authorized by the Department..."
It's not unusual for the State Department to issue a second valid passport to individuals who may visit different countries that are hostile to one another.
It can be... uncomfortable... to present your passport with an Iranian Stamp in it, to Israeli Immigration, for example.
Use the other one.

@KrunosIav If he was issued a second Regular passport, he was also issued an explanatory letter from the State Department to keep with it; in which case, that letter was probably "seized" (stolen) as well.
The State Department should have those records, but if it's up to Biden's SecState Blinken, or Merrick Garland... we're never going to know about it.
The point is, he's almost certainly not "prosecutable" for anything. And even if he were, it's just about the lamest, most-trivial administrative technicality ever...
The only goal here is to create the illusion of some "nefarious subterfuge" for the Trump-haters to cling to and make up stories about... i.e. "Bullshit"
If Trump actually tried to travel unnoticed to some out-of-network black site somewhere on a mission of "international intrigue" to do... to do... (God knows what these idiots are imagining he's going to do; I don't even think they know...); then he's certainly not going to need to present a "valid Passport" when he hits the ground 
I wondered about that as well as I know the law concerning passports.
