If Trump replaces RBG, it will provide the right with an illegitimate 6-3 majority, whereas if Merrick Garland had been confirmed, “as he should have been,” that would be fine. So says Eric Holder. Clearly, the solution, once Biden is installed and they take back the Senate, is to pack the court with more judges. Shades of FDR, who tried it and got slapped down for it. The same for large chunks of his New Deal. Coloring this year’s model green won’t change that.

Wouldn't they need a majority in both chambers of congress to change the number of justices in SCOTUS? Wouldn't they also need POTUS on board (or a veto-proof majority)? I can't see that happening for quite some time!

Seems to me that the reason for the attempt in the first place, a conservative majority in the court, pretty much would guarantee that the effort would never survive a constitutional challenge. So o guess they’re back to shredding the constitution and burning it all down.
